For far too long, insurance coverage was too complicated, difficult to get, and discriminated against those suffering from mental illnesses and substance use disorders (SUDs). A lack of understanding existed around the fact that mental health and drug use problems are just as essential as physical health and that failing to provide treatment can be debilitating and even life-threatening.

According to the Affordable Care Act (ACA), benefits for mental health and substance use disorders must be equal to those provided by health plans and insurers that provide basic medical and surgical coverage. In practice, however, parity is only significant if health insurance plans execute it properly, customers and providers understand how it works, and sufficient supervision is in place.

Essential Benefits: Addiction and Mental Health Coverage

Mental health and substance use disorder treatment are classified as essential health benefits under all Marketplace insurance plans. This means that every plan must provide coverage for the following services:

  • Behavioral health treatment, including psychotherapy and counseling
  • Inpatient mental and behavioral health services
  • Substance use disorder treatment (also known as substance abuse treatment)

The exact coverage and benefits you receive will vary based on your state and your chosen health plan. Your insurer’s plan documents will include a detailed breakdown of what’s covered. Importantly, all Marketplace plans must:

  • Cover pre-existing mental and behavioral health conditions from the start of your coverage
  • Provide equal coverage without charging more based on a pre-existing condition, including mental health or substance use disorders
  • Prohibit yearly or lifetime dollar limits on essential health benefits

In addition, federal law requires “parity protections” for mental health and addiction services. This means that your insurance provider cannot impose stricter limitations on these services than they do on standard medical or surgical treatments. Parity protections apply to:

  • Financial requirements – such as deductibles, copayments, coinsurance, and out-of-pocket maximums
  • Treatment limits – including caps on the number of covered days or visits
  • Care management – such as requirements for prior authorization before receiving treatment
